Terms of Service

1. Introduction & Acceptance of Terms

START Online Business Academy (“START,” “we,” “our,” “us”) provides access to its website, educational programs, digital platforms, business training services, and related tools (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Services.

2. Educational Purpose & No Professional Advice

START provides educational and informational services only. The Services, including all courses, programs, workshops, resources, and related materials, are designed to support learning, skill-building, and informed decision-making for aspiring and current founders. The Services do not constitute, and should not be relied upon as, legal, financial, tax, accounting, investment, or regulatory advice. You are solely responsible for consulting with professionals regarding your business matters.

3. Eligibility & User Responsibilities

Eligibility
  • You must be at least 18 years of age to access or use the Services.
  • By using the Services, you represent and warrant that you have the legal capacity and authority to enter into these Terms.
User Responsibilities

By using the Services, you agree to:

  • Provide accurate, current, and complete information when creating an account, enrolling in a course, or submitting materials.
  • Maintain the security and confidentiality of your login credentials and account information.
  • Promptly notify START of any unauthorized use of your account or any breach of security.
  • Use the Services for lawful purposes only and in compliance with all applicable laws and regulations.
  • Respect the intellectual property, privacy, and rights of START, its instructors, partners, and other users.

You are responsible for all activities that occur under your account, whether or not authorized by you.

4. Course Access, Enrollment & Use

When you enroll in a course, program, or other offering, START grants you a limited, non-exclusive, non-transferable, revocable license to access and use the applicable course materials solely for your personal, non-commercial educational purposes, subject to these Terms and any additional guidelines presented at enrollment.

You may not:

  • Share, sell, rent, lease, sublicense, or otherwise transfer your enrollment, login credentials, or access rights to any third party.
  • Reproduce, distribute, modify, adapt, translate, publicly display, publicly perform, or create derivative works of any course content, templates, tools, or materials without prior written permission from START.
  • Circumvent or attempt to circumvent any technical protection measures related to the Services or course materials.

START reserves the right to monitor access to and use of the Services to help protect the integrity of the platform and ensure compliance with these Terms.

5. Payments, Refunds & Pricing

Payments

  • All fees, prices, and payment terms for courses, programs, and related services are displayed at the point of purchase or enrollment.
  • By submitting payment information, you authorize START or its third-party payment processors to charge the applicable fees to your selected payment method.

Refunds

  • Unless expressly stated otherwise in a specific program, offer, or policy, all sales are final and non-refundable.
  • Any applicable refund terms, if offered, will be set out in the program description or in a separate written policy made available at the time of purchase.

Pricing & Changes

  • START reserves the right to modify pricing, payment structures, available plans, or program offerings at any time, with or without notice, for future enrollments.
  • Price changes will not affect purchases that have already been completed, except as otherwise stated in applicable policies.

6. Recognition, Verification & Directory Listings

Recognition and verification-related offerings, including but not limited to recognition status, verification badges, endorsements, or listings in any START directory, are earned outcomes and are not guaranteed.

Eligibility for recognition, verification, or directory placement may depend on factors such as:

  • Completion of specific coursework, trainings, or milestones;
  • Submission of accurate and complete verification materials;
  • Adherence to START’s internal standards, policies, and review criteria; and
  • Ongoing compliance with these Terms and any applicable program guidelines.

START reserves the right, in its sole discretion, to:

  • Approve, deny, or request additional information for any recognition or verification request;
  • Modify, pause, or discontinue recognition or directory programs;
  • Suspend, downgrade, or remove recognition status, badges, or directory listings if information is found to be inaccurate, incomplete, misleading, or in violation of START’s standards or these Terms.

Recognition, verification, and directory placement are not legal, regulatory, or governmental approvals and do not constitute a guarantee of business quality, compliance, performance, or outcomes.

7. User Submissions & Content

From time to time, you may submit documents, screenshots, links, testimonials, business information, or other materials (collectively, “User Submissions”) to START, including for coursework or assignment review; verification, recognition, or directory evaluation; and feedback, case studies, or participation in success stories.

By providing any User Submissions, you:

  • Grant START a worldwide, non-exclusive, royalty-free license to use, review, reproduce, store, display, and otherwise process such User Submissions for purposes of delivering the Services, conducting evaluations, improving programs, and operating any recognition or directory-related functions.
  • Represent and warrant that you own or otherwise have all rights, permissions, and authority necessary to submit the User Submissions and to grant the above license.
  • Agree that certain User Submissions (such as testimonials, case studies, or directory entries) may be displayed or referenced publicly if you provide explicit written consent or opt in to such use.

START reserves the right, but is not obligated, to remove or decline to use any User Submissions that it determines, in its sole discretion, violate these Terms, applicable law, or community standards.

8. Intellectual Property

All content and materials made available through the Services—including but not limited to course content, text, graphics, logos, trademarks, service marks, videos, audio, templates, worksheets, systems, methodologies, processes, software, and other resources—are the property of START or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws.

Except as expressly authorized in these Terms or in writing by START, you may not:

  • Copy, reproduce, distribute, publish, transmit, modify, create derivative works from, or publicly display any part of the Services or their content;
  • Use any trademarks, service marks, or branding associated with START in any manner that is likely to cause confusion or imply endorsement or sponsorship without prior written permission.

All rights not expressly granted to you in these Terms are reserved by START and its licensors.

9. Platform Availability & Modifications

START aims to provide reliable access to the Services but does not guarantee that the Services will be available at all times or free from interruption, errors, or delays.

  • The Services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond START’s control;
  • START may, at any time and without prior notice, update, modify, suspend, or discontinue any part of the Services, features, or content;
  • START shall not be liable for any loss, disruption, or inconvenience caused by any such unavailability or modification, to the fullest extent permitted by law.

10. Disclaimers & Limitation of Liability

No Guarantees or Earnings Claims

The Services are intended to provide education, frameworks, and tools to support your entrepreneurial learning and decision-making.

  • START does not guarantee any specific business results, outcomes, income, revenue, or level of success. Any examples of past results, case studies, or testimonials are illustrative only and do not represent a promise or prediction of future performance.
Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

  • START, its owners, officers, employees, contractors, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Services.
  • START’s total aggregate liability for any claim arising out of or relating to the Services or these Terms shall be limited to the amount you paid (if any) for the specific course, program, or service giving rise to the claim during the twelve (12) months preceding the event giving rise to such claim.

Some jurisdictions do not allow certain limitations of liability or exclusion of implied warranties. In such cases, some of the above limitations may not apply to you, and the liability of START shall be limited to the minimum extent permitted by applicable law.

11. Termination

START reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Services, your account, or any specific course or program at any time, with or without notice, if:

  • You violate these Terms or any applicable policies or guidelines;
  • You misuse the Services or engage in conduct that START determines may harm START, other users, or third parties;
  • Required by law, regulation, or governmental request.

Upon termination, your right to access the Services will cease immediately. Termination will not limit any rights or remedies available to START under these Terms or at law or in equity.

12. Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to the Services or these Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Montana, and you hereby consent to the personal jurisdiction and venue of such courts.

13. Updates to These Terms

START may revise, update, or otherwise modify these Terms from time to time. When changes are made, START may update the effective date or “last updated” date at the top of this page or provide additional notice where required by law.

Your continued access to or use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
